These Terms and Conditions set out the basis on which Rubbish Clearance Bermondsey provides rubbish clearance and waste collection services. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

2. Scope of Services

2.1 We provide rubbish clearance and waste collection services, which may include manual loading of waste into our vehicles, sorting and segregation of certain materials, and transportation to a licensed waste transfer station or disposal facility.

2.2 The exact nature and extent of the services will be as agreed at the time of booking or as updated during the visit if the volume or type of waste differs from that originally described.

2.3 We reserve the right to refuse to remove certain items, including but not limited to hazardous waste, clinical waste, asbestos, gas bottles, chemicals, solvents, oils, paint, tyres, pressurised containers, and any other materials that we are not licensed or insured to carry or that may pose a health and safety risk.

2.4 We will perform the services with reasonable care and skill and in accordance with applicable UK waste regulations and duty of care requirements.

3. Booking Process

3.1 You may request a booking by telephone, email, or through any other booking method we make available. Bookings are subject to availability and are not confirmed until we have provided a booking confirmation.

3.2 At the time of booking, you must provide accurate information about the type, approximate volume, and location of the waste, together with any access restrictions such as parking limitations, stairs, or security requirements.

3.3 Any quotation provided before our arrival is based on the information you give us. If, on attendance, we find that the volume, type, or location of the waste differs from what was described, we may adjust the price or, if necessary, decline to carry out part or all of the services.

3.4 We will aim to attend within the agreed time window, but any times given are estimates only. We will not be liable for any loss or damage resulting from delays or failure to attend within estimated time frames, provided we use reasonable endeavours to perform the services as soon as practicable.

4. Access and Site Requirements

4.1 You are responsible for ensuring that we have safe and reasonable access to the Site and to the waste that is to be collected. This includes arranging any required permissions for parking, entry to premises, or access through communal areas.

4.2 If parking charges or permits are required to access the Site, you are responsible for providing a permit or meeting any parking fees unless otherwise agreed in advance. Any parking fines or penalties incurred due to inaccurate information or failure to provide suitable parking may be added to your invoice.

4.3 You must ensure that the Site is safe for our operatives and free from avoidable hazards. We may suspend or cancel the services if we consider the Site unsafe or if performing the services would breach health and safety requirements.

5. Pricing and Quotations

5.1 Our prices are generally based on the volume of waste removed, the type of waste, the weight where applicable, and the time taken to complete the job. Additional charges may apply for difficult access, heavy materials, or special handling requirements.

5.2 Any quotation provided before we see the waste is an estimate only, based on the details you supply. The final price will be confirmed on Site after our assessment of the waste and access conditions.

5.3 If you do not accept any updated price presented on Site, you may decline the service. However, a call-out or attendance charge may apply if we have incurred costs in attending your Site, which will be notified to you at the time of booking or before commencement.

5.4 All prices quoted are exclusive of any applicable VAT unless stated otherwise. If VAT is chargeable, it will be added to the invoice at the prevailing rate.

6. Payments

6.1 Payment is due in full on completion of the services, unless we have agreed alternative payment terms in writing prior to the visit. For most domestic customers, payment is required immediately upon completion.

6.2 We may accept payment by cash, credit or debit card, bank transfer, or other methods as we notify from time to time. We do not accept cheques unless agreed in advance.

6.3 For business customers who have an approved account, payment must be made within the agreed credit period as stated on the invoice. If no period is specified, payment is due within 14 days of the invoice date.

6.4 If you fail to make payment when due, we may charge interest on the overdue amount at the statutory rate allowed under UK law, accruing on a daily basis until payment is made in full. We may also recover reasonable costs of debt collection.

6.5 Ownership of any recyclable or salvageable materials passes to us once collected, and no allowance is made in the price for any potential resale value unless expressly agreed otherwise in writing.

7. Cancellations and Amendments

7.1 You may cancel or amend your booking by giving us reasonable notice by telephone or email. As a guide, we request at least 24 hours notice for cancellations or significant changes to bookings.

7.2 If you cancel with less than 24 hours notice, or if we arrive at the Site and are unable to carry out the services due to reasons within your control, we may apply a cancellation or wasted journey fee to cover our costs.

7.3 We reserve the right to cancel or reschedule the services if our operatives are unable to attend due to vehicle breakdown, extreme weather, illness, or other circumstances beyond our reasonable control. In such cases, we will aim to reschedule the booking to a mutually convenient time and no cancellation fee will apply.

7.4 If you wish to add or remove waste items from your booking, we will use reasonable endeavours to accommodate the change, but this may affect the price and the time needed to complete the work.

8. Waste Description and Prohibited Items

8.1 You are responsible for accurately describing the waste to be collected and for separating any items that are not to be removed. Our operatives will generally rely on your instructions regarding which items to take.

8.2 We do not accept responsibility for removing any items that you failed to identify as not for disposal if they are mixed with waste or presented in a way that reasonably indicates they are to be removed.

8.3 We are not obliged to remove any prohibited or hazardous items. If we discover such items amongst the waste after loading, we may unload them at the Site or at another safe location, and additional charges may apply for handling and any necessary remedial action.

8.4 You agree not to present for collection any waste that is in breach of applicable UK waste regulations or that is misdescribed so as to avoid correct classification, fees, or disposal routes.

9. Waste Handling and Environmental Compliance

9.1 We will handle, transport, and dispose of waste in accordance with applicable UK environmental legislation, including duty of care requirements, licensing obligations, and waste transfer documentation where relevant.

9.2 We will use licensed waste transfer stations and disposal facilities and will aim to divert waste from landfill where reasonably practical, through recycling or recovery, subject to the capabilities of the facilities used.

9.3 Upon request for eligible commercial loads, we may provide a waste transfer note or summary details of disposal, subject to our standard administrative processes.

9.4 Once waste has been removed from the Site and loaded into our vehicle, responsibility for that waste passes to us. Prior to loading, responsibility and legal control of the waste remain with you.

10. Customer Responsibilities

10.1 You must ensure that you have the legal right to arrange removal of the waste and that you have obtained any necessary permissions from property owners, landlords, or managing agents.

10.2 You must ensure that all personal items, documents, and valuables are removed from the waste and from any items presented for clearance before our operatives begin work.

10.3 You agree to provide truthful and accurate information during the booking process and on the day of service, including details of any access limitations, potential hazards, or unusual waste types.

10.4 You agree to treat our operatives respectfully and to refrain from abusive, threatening, or obstructive behaviour. We may withdraw our services and leave the Site if our staff are subjected to unacceptable conduct.

11. Liability and Limitations

11.1 We will take reasonable care when carrying out the services, but minor scuffs or marks may occur during the movement of bulky items. We will not be liable for cosmetic damage to walls, floors, or fixtures that is reasonably incidental to properly performed services, unless caused by clear negligence.

11.2 We will not be liable for the loss of, or damage to, any items that you intended to keep if they were presented as waste, were not clearly separated, or were not brought to our attention before removal.

11.3 Our total liability to you for any loss or damage arising out of or in connection with the services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the relevant services, except where such limitation is not permitted by law.

11.4 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot lawfully be excluded or limited.

11.5 We will not be liable for any indirect or consequential losses, including loss of profit, loss of business, or loss of opportunity, arising from our provision or non-provision of services.

12. Complaints and Disputes

12.1 If you have any concerns or complaints about the services, you should notify us as soon as reasonably possible, preferably on the day of service or within 48 hours of completion.

12.2 We will investigate any complaint and may request supporting information, including photographs or a written description of the issue. We will seek to resolve complaints fairly and promptly.

12.3 Raising a complaint does not suspend your obligation to pay for services that have been properly carried out, but any proven overcharge or agreed adjustment may be credited or refunded.

13. Force Majeure

13.1 We will not be in breach of these Terms and Conditions or liable for delay in performing, or failure to perform, any of our obligations if such delay or failure results from events, circumstances, or causes beyond our reasonable control.

13.2 Such events may include, but are not limited to, extreme weather, flooding, fire, strikes or industrial action, road closures, serious vehicle breakdowns, accidents, or changes in law or regulation affecting the provision of waste services.

14. Data Protection and Privacy

14.1 We will collect and process your personal information only as necessary to manage bookings, provide services, issue invoices, and handle customer service matters.

14.2 Your details may be stored securely for a reasonable period for accounting and legal purposes. We will not sell your personal data to third parties.

14.3 We may share limited information with service providers such as payment processors or IT support companies strictly for the purpose of delivering our services and managing our business, subject to appropriate confidentiality obligations.

15. Changes to These Terms

15.1 We may amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the updated terms are published or communicated.

15.2 The version of the terms that applies to your booking will be the version in force on the date you make the booking, unless we agree otherwise in writing.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or with the services shall be governed by and construed in accordance with the laws of England and Wales.

16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services.

17. Severability

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and Rubbish Clearance Bermondsey in relation to the services and supersede any prior discussions, correspondence, or understandings.
